Appeals Court denies Chatham Park appeal on seeking sanctions against Pittsboro Matters
July 19, North Carolina Court of Appeals, in a unanimous opinion, affirmed a lower court ruling that had denied a motion for sanctions brought by Chatham Park Investors (CPI) against Pittsboro Matters.
“Where the plaintiff’s [Pittsboro Matters] motion for preliminary injunction was well grounded in fact and warranted by existing law and was not brought for any improper purposes,” the three member Appeals Court unanimously concluded,” we affirm the judgment of the trial court denying a motion for sanctions…” brought by CPI against Pittsboro Matters.

CPI had sought $59,000 in legal fees from Pittsboro Matters – a local, grass roots, all volunteer, non-profit – for a half-day court hearing.
